If a worker disputes a decision made about their claim they should lodge a Notice of Dispute with the Workers Compensation Tribunal and get legal advice.
The Workers Compensation Tribunal will hear the dispute. Before a hearing is held there is a compulsory Conciliation Conference. Many disputes are resolved at Conciliation without the need for a hearing. A worker should have good advice about their claim before and what would be reasonable terms of settlement before the Conciliation Conference. A percentage of the workers legal fees will be reimbursed from WorkCover provided the proceedings were not initiated frivolously or vexatiously. If the worker is a Commonwealth employee the worker can request a review by a review officer.
