A general power of attorney can be used when you need someone to look after your affairs for a particular reason. For example you may be travelling overseas. 

An enduring power of attorney is granted so that someone can make decisions about your property and financial affairs when you no longer have ‘legal capacity’

A medical power of attorney gives someone the power to make decisions about your medical treatment if you are unable to do so yourself. 

To make a Power of Attorney you must be over 18 and of sound mind.

It is best to have a lawyer draw up the document so that it is in the correct legal form.

If you want your attorney to be able to deal with land the document will need to be registered.  

The donee must keep proper records of everything he or she does, and must act in the best interests of the donor at all times.

A power of attorney gives the donee significant power to deal with your affairs so you should consider very carefully who should have that power. 

Once made, you can revoke your power of attorney provided you are still of sound mind.

 

Remember to provide the full name, residential address and occupation of any person you want to have your power of attorney.
