Medical negligence may be caused by occurrences such as misdiagnosis; failure to diagnose or poor medical treatment. Negligence is a failure to take reasonable care.


The standard of care expected is that of a reasonably competent practitioner in that field. It is different from mistake or error of judgment. It will usually be necessary to seek the expert opinion of another medical practitioner in the relevant field as to determine whether you have a medical negligence claim.


If successful in a claim for medical negligence compensation may be awarded for medical expenses and appliances; care and domestic assistance and pain and suffering.

A three year time limit applies for taking actions for personal injury, including medical negligence but there are circumstances in which the time limit is extended.
